The Value of a Case Depends on Having the Right Lawyer

September 15, 2009 /Parenting PR News/ -- The Value of a Case Depends on Having the Right Lawyer

A court case can be a lot like a Rubik's Cube: there's more than one way to approach it; the outcome varies depending on that approach; and the ultimate success achieved is determined by both the line of attack chosen and the skill with which that approach is executed.

If you or anyone you know has been injured and you're facing the possibility of taking a case to court, it's important to find the right lawyer to help you. This attorney must have the experience and skill to argue effectively on your behalf for full compensation.

Successful lawyers are able to view cases from all angles, pulling together the relevant, supporting information needed to pursue them. Since there is rarely a set value of any case, lawyers are largely limited only by knowledge and ingenuity.

For example, consider a car accident that results in long-term back and neck pain. The lawyer must navigate issues of liability and consider all potential sources of compensation.

Clearly if the other driver caused the accident he or she may be held accountable. However, an effective attorney must consider whether that person was driving as part of his or her employment -- in which case the employer may also be held liable. The attorney must consider the soundness of the design and manufacturing of the vehicle, to determine if negligence on the part of the auto manufacturer contributed to the injuries. An accident may be aggravated by the negligence of a city or county if the roads were improperly maintained or poorly designed. Simply put, the lawyer must look outside the box to ensure the appropriate amount of coverage to compensate the seriously injured individual.

Once liability is established, an effective attorney must consider the full scope of the damages. Some damages are readily valued; past medical bills and time already lost from work may be assigned a clear cost. When the injuries will affect future productivity or require ongoing treatment though, the ultimate value of the case becomes more dependent on the skill of an attorney.

If a lawyer leads a jury to consider daily headaches as a mere inconvenience or nuisance, these headaches will be valued less highly than if the lawyer leads the jury to consider this time as lost productivity for the remainder of one's career.

The lawyer you choose does make a difference. When you are considering a personal injury lawsuit following an injury, make sure that you choose an attorney carefully.
